The article said she broke his phone, so you're speculation that he was cheating on her is probably correct. Guessing she's hardly blameless in the situation, but it's still no excuse for him to lay his hands on her.

Obviously we should wait to judge, but per the article Ogletree admitted to at least shoving her down. That and the fact that they're holding him w/out bond probably means he's in deep shit.
